2. Your Gardener’s Responsibilities

To ensure a smooth experience for all, you agree to:

• Provide accurate, current, and complete information when creating an account or placing an order.
• Ensure your shipping address is correct and deliverable. We are not responsible for orders lost due to incorrect addresses provided by you.
• Use the website only for lawful purposes and not to interfere with its operation.
• Review your order confirmation and shipping notifications promptly.
• Understand that plants are living materials and their success depends partly on local conditions, planting timing, and care after they leave our facility.

3. Products & Services Description

We take great care in describing and packaging our plants and bulbs. However, please note:

• Living Products: Our plants, bulbs, and seeds are perishable. Photos are for illustrative purposes; size, color, and exact appearance may vary slightly based on season and growth cycle.
• Regional Suitability: It is your responsibility to ensure the plants you order are suitable for your hardiness zone and growing conditions. We provide guidance, but ultimate selection is your choice.
• Availability: All products are subject to availability. We may limit quantities and discontinue items at any time.

4. Orders & Payment Terms

Placing an Order:

Your order is an offer to purchase. We accept it only when we send an order confirmation email. We reserve the right to cancel any order for reasons including, but not limited to, product availability, errors in pricing, or suspected fraud.

Pricing & Payment:

• Prices are listed in US Dollars (USD).
• We accept: Visa, MasterCard, JCB, and PayPal.
• You authorize us to charge the total amount (product price + shipping + any applicable taxes) to your selected payment method upon order confirmation.
• Prices may change without notice but will not affect confirmed orders.

Shipping:

By placing an order, you agree to our shipping policy, which is an integral part of these Terms.

• Processing: Orders are processed within 1-2 business days after payment confirmation.
• Methods:
  • Standard Shipping ($12.95): Via DHL or FedEx. Estimated delivery 10-15 business days after dispatch.
  • Free Shipping: Via EMS for orders over $50. Estimated delivery 15-25 business days after dispatch.
• Delivery Areas: We ship globally but cannot ship to select remote regions and parts of Asia. You are responsible for any import duties, taxes, or customs fees in your country.
• Delivery Delays: We provide estimates, but delays due to customs, weather, or carrier issues are beyond our control and do not qualify for refunds unless the item is lost.

5. Returns, Exchanges & Refunds

Our goal is your complete satisfaction. Our detailed Returns & Exchanges Policy is part of these Terms. Key points include:

• Eligibility: Returns or exchanges must be initiated within 15 days of receiving your shipment.
• Process: Contact our Gardener Care Team at [email protected] to receive an RMA number and instructions.
• Non-Returnable Items: For the health of our living products, we cannot accept returns for:
  • Planted bulbs or plants, or those showing active growth.
  • Items not in resalable condition due to time or improper storage.
  • Final Sale or Non-Returnable items.
  • Personalized collections (e.g., custom Fall-Planted Bulb Collections).
• Damaged/DOA Items: Report damaged or Dead-on-Arrival items within 48 hours of delivery with photos for a prompt replacement or refund.
• Refunds: Issued to the original payment method within 7-10 business days after we receive and approve the return. Original shipping fees are non-refundable.

6. Intellectual Property

The entire content of the plantgardenonsale.com website—including text, graphics, logos, images, plant descriptions, and software—is our property or the property of our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

High Country Gardens Shop and its affiliates will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the site or any products purchased, including but not limited to loss of plants due to weather, improper planting, pests, or local growing conditions beyond our control.

Our total liability for any claim related to your order shall not exceed the total amount you paid for the specific product(s) giving rise to the claim.

8. Governing Law & Contact

These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, United States. Any disputes shall be resolved in the state or federal courts located in Philadelphia, PA.
